Auburn resident told to ‘clean up’, town rezones

TOWN of AUBURN- Supervisors have approved a directive giving the township’s attorney permission to bring a lawsuit against Robert and Ann Rudzitis for violation of various town ordinances. Ann Rudzitis, who was in attendance at the town board meeting Monday, May 14, was told the lawsuit could be avoided if she and her husband bring their property back up to code.

The zoning violations center on abandoned vehicles, and items the township views as junk at their property on Highway G and Auburn Ashford Road. Town chairman, Merle Laatsch stated the township has been receiving complaints about the property.



This isn’t the first time the township has had encountered a problem with the Rudzitis’ property. In 1994 the town received a court judgment granting an injunction.

That injunction ordered the homeowners to clean up all junked motor vehicles and vehicle accessories along with any scrap metal, construction debris and miscellaneous refuse. The order also restrained the Rudzitis’ from storing or allowing disassembled, dismantled, partially dismantled, junked, wrecked, or non-operable, unlicensed motor vehicles. They were also ordered to pay a fine of $25 per day from January of 1994 until September of that year totaling $5,875.

Town officials stated that the Rudzitis’ complied with the order at that time but are in non-compliance once again.

Ann Rudzitis told the town board that she wants to remedy the situation. However she requested a copy of the ordinance so she and her husband could assess the violations.

The town board will meet with the Rudzitis’s on Thursday, May 24. Supervisor Joe Woodworth motioned that the town give permission for the attorney to bring legal action if the situation is not handled.

Woodworth stated after the meeting that he wanted to give the Rudzitis the opportunity to take care of the situation on their own before taking legal steps afforded to the township.

Supervisors acted on a plan commission recommendation to rezone 15.58 acres for Ronald Furlong. The land south of Highway SS was rezoned residential district (RD) from exclusive ag (EAG). The rest of the property will remain in EAG. A deed restriction of one house per lot will be enforced.

Supervisors also voted to rezone 29 acres from EAG to RD for Edward Kirsch. Again acting on a Plan Commission recommendation with a deed restriction. Kirsch asked to have the land divided into four lots.

The town will be purchasing a small trailer for cemetery maintenance. The trailer to be purchased has a 5-foot by 8-foot box and a 3,500-pound axle. Total cost is $980

Road inspection has been completed and a bid from the Fond du Lac County Highway Department has been received for the various projects. Laatsch reported the bid seemed high and he would be sending the projects out for bidding. If the bidding does not improve, the township may consider limiting the road projects for the year.

Laatsch explained that Fond du Lac County had done the work cheaper in the past, which is why he asked them for a bid. Next month it will be reported on again after additional bids are received.

Laatsch also reminded those in the audience that it has been brought to his attention that someone is trimming trees in the road right-of-way. He reiterated that this is illegal and anyone caught doing so will receive a citation.
